Agreement

These Terms of Service govern your use of Commutro, including commutro.com and app.commutro.com (collectively, the "Service"). By accessing or using the Service or purchasing a report, you agree to these Terms. "Commutro", "we", "us", and "our" refer to the operator of the Service.

If you use the Service on behalf of a company or other organization, you represent that you have authority to agree to these Terms on its behalf. You must be at least 18 years old to purchase a report.

The Service

Commutro compares candidate office buildings by modeled rush-hour commutes. The instant snapshot is free. The price for a full report is the price shown at checkout. Each purchase is a one-time purchase, not a subscription. Prices are exclusive of applicable taxes unless stated otherwise.

A full report opens as an online report as soon as your payment completes, and we email you a link to it. It includes an executive PDF you can download. We intend to keep each online report accessible for at least 90 days after purchase, subject to temporary outages and circumstances outside our reasonable control. Reports may expire after that period. The executive PDF is yours to keep. If access to a paid report is permanently lost during the initial 90-day period, we will use reasonable efforts to restore or re-deliver it.

Reports are estimates

Commute figures are modeled from historical traffic and published transit timetables, with the methodology stated in each report. They are estimates, not guarantees of actual travel times.

A Commutro report evaluates commute-related factors only. It does not evaluate all factors relevant to an office location, leasing, or site-selection decision, and it is not real estate, brokerage, transportation, employment, legal, financial, or other professional advice. Decisions you make on the basis of a report are yours.

Refunds

If a full report you paid for cannot be generated or does not arrive, we will refund the purchase. Otherwise, because the full analysis is delivered immediately on purchase, sales are final.

Your data

You retain your rights in information you submit to Commutro. You grant Commutro the rights necessary to process that information to operate the Service, perform the requested analysis, generate your report, and otherwise use the information as described in our privacy policy.

Acceptable use

Sharing your report

Your report link and PDF are yours to share, for example with your leadership team or broker, for as long as the link is live. The Service itself, including its software and methodology, remains Commutro's.

Landlord and brokerage embeds

Embedding Commutro on a website is governed by a separate agreement. See Commutro for business.

Every site that embeds Commutro must display a visible "Powered by Commutro" notice alongside the widget, as a direct link to commutro.com in the page's own HTML, and must not remove, obscure, or alter it.

Data sources and attribution

Commutro's analyses and reports draw on licensed and public data sources. These include traffic and map data from TomTom and its suppliers, map and place content from Google and Mapbox, OpenStreetMap data © OpenStreetMap contributors under the Open Database License, data published by the United States Census Bureau, and transit schedules published by MTA, MTA Bus Company, NJ TRANSIT, PATH (Port Authority of NY & NJ), SEPTA, PATCO, NYC Ferry, NYC DOT, NY Waterway, LA Metro, Metrolink, MBTA, WMATA, MARC, VRE, MARTA, Metro Transit, TriMet, Pittsburgh Regional Transit, Greater Cleveland RTA, Sound Transit, King County Metro, Washington State Ferries, CTA, Metra, South Shore Line, Miami-Dade Transit, Tri-Rail, Brightline, BART, Caltrain, SFMTA, VTA, San Francisco Bay Ferry, and Golden Gate.

Commutro is not sponsored, affiliated, or operated by Metra. Schedule data is provided as-is, without warranty, and agencies may change service at any time. These agencies and providers do not endorse Commutro.

All third-party data is supplied as is. It may be incomplete, delayed, inaccurate, unavailable, or changed without notice, and Commutro does not control it or guarantee its accuracy or availability.

Map and traffic data from TomTom and its suppliers, like all third-party data, remains the property of its licensors and is used only to produce the figures in your reports. You may not use the Service to extract or reconstruct the underlying data. TomTom and the other data providers supply their data without warranty and accept no liability to you.

Parts of the Service and reports display content from Google Maps. By using those parts you agree to the Google Maps/Google Earth Additional Terms of Service and the Google privacy policy.

Service provided as is

The Service is provided as is and as available, without warranties of any kind, express or implied. We do not promise that the Service will be uninterrupted or error free.

Liability

To the maximum extent permitted by law, Commutro will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, business opportunities, goodwill, or data arising from or related to the Service.

To the maximum extent permitted by law, Commutro's total liability arising from or relating to the Service will not exceed the amount you paid for the report giving rise to the claim.

Refusal and termination

We may refuse or suspend use of the Service that violates these Terms, abuses the Service, or creates risk for Commutro or others. If we terminate a purchase you made in good faith, we will refund it.

Governing law and venue

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute arising from or relating to these Terms or the Service will be brought in the state or federal courts located in New York County, New York.

Changes to these Terms

We may update these Terms. The current version is always at this address, with its date above, and changes apply from the date they are posted.

General

These Terms, together with the privacy policy and any additional terms presented for a specific service, constitute the agreement between you and Commutro regarding the Service. If any provision is found unenforceable, the remaining provisions will remain in effect. A failure by Commutro to enforce a provision does not waive its right to do so later. Commutro may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, or transfer of the Service.
